Marijuana law in Virginia has a different look......

During the 2017 Session §§18.2-251, 259.1 and 46.2-390.1, were amended to remove the mandatory six month driver's license suspension for a person convicted of or placed on deferred disposition for simple possession of marijuana. This applies only to adults and does not affect the requirement of a license suspension for any other drug conviction or deferred disposition.
 
What received less attention after the Legislative session was the "enactment clause" which delayed the implementation until the Virginia Department of Transportation received written assurance from the Federal Highway Administration of the U.S. Department of Transportation that Virginia would not lose federal funds as a result of the implementation of the act.  We have just received notification from the Supreme Court that the requisite assurances have been received and the Department of Motor Vehicles has been directed to take the necessary action to implement the changes.
